LAUREL COUNTY, Ky. —
Just two days after her murder trial ended in a hung jury, the woman accused of shooting her lawyer husband was back in court.
Lisa Gilliam and her attorneys, Scott Foster and Robert Norfleet of Somerset, were back before Special Circuit Judge Robert McGinnis on Friday for a two-fold purpose.
“We filed for a bond reduction and it was reduced from $100,000 cash to $75,000,” said Norfleet. “We also filed a motion for Judgment of Acquittal.”
That judgment, Norfleet said, is “a criminal rule of procedure.”
“If a jury fails to reach a unanimous verdict, the defense can ask for dismissal.”
Norfleet said defense attorneys have until Oct. 1 to file a memorandum of support for that motion to dismiss the case against Lisa Gilliam. The Commonwealth Attorney’s Office will have 14 days after that, or Oct. 14, to respond to the motion to dismiss.
After three days of evidence and arguments by defense and prosecution attorneys, the three-man, nine-woman jury could not come to an agreement whether Larry Gilliam committed suicide or if Lisa shot her husband of only 44 days. After McGinnis accepted the jury’s inability to come to a unanimous decision, or more commonly known as a “hung jury,” he scheduled another pretrial for Oct. 19. Norfleet said the defense and prosecution attorneys would argue their case for an acquittal — or not — on that date.
Lisa Gilliam is charged with the shooting death of her husband, London attorney Larry Gilliam, on Jan. 7, 2011. The two were alone in Gilliam’s Fourth Street office when the shooting took place. Lisa Gilliam was indicted for murder by a Laurel grand jury in March 2011. She posted a $100,000 cash bond three days later when she voluntarily turned herself in to the London Police Department, which is the agency that led the investigation into the incident.
