Sex case goes to grand jury

London couple charged with rape, sodomy of juvenile

LAUREL COUNTY, Ky. — The December grand jury will hear evidence against a London couple accused of first-degree rape and sodomy against a mentally challenged girl.

Dustin and Charlene Brummett of 1600 Laurel River Church Road stood beside each other in Laurel District Court on Tuesday morning during a preliminary hearing on charges that they allegedly raped and sodomized a juvenile several times this year.

Dustin Brummett was arrested just after midnight on Nov. 2 and charged with third-degree sodomy and first-degree rape. His wife, Charlene Brummett, 37, was arrested around 9 p.m. the same day on the same charges.

Kentucky State Police Trooper Jack Riley testified he accompanied London Police/Laurel Sheriff’s Detective Stacy Anderkin and a representative of the Cabinet for Families and Children to a residence for a check after receiving a complaint of sexual abuse of a juvenile.

Riley said he questioned 25-year-old Dustin Brummett concerning the allegations and the man admitted to having sexual intercourse with the juvenile.

While the victim is above Kentucky’s age of consent of 16, the rape charges are upgraded because the victim has an IQ of 40. According to the Binet Scale of Human Intelligence, an IQ of 40 places the victim in the “severe” category of mental disability.

Judge Wendell “Skip” Hammons ruled probable cause that a felony offense had been committed and referred the case to the December meeting of the grand jury. According to Kentucky law, felony cases cannot be tried at the district court level and are sent before a grand jury evidential hearing for possible indictment. Those indicted then have their cases heard at the circuit court level.

The Brummetts are held in the Laurel County Detention Center and are scheduled to appear in Laurel Circuit Court for possible indictment on Dec. 21. Dustin Brummett is held under a $250,000 cash bond; Charlene Brummett is held under a $25,000 cash bond.
