LAUREL COUNTY, Ky. —
The woman who allegedly left her infant child to go partying with her boyfriend could face indictment by a Laurel grand jury this week.
Rachel Kilburn, 29, is charged with abandonment of a minor and faced a preliminary hearing in Laurel District Court on Sept. 6. Evidence indicating Kilburn left her 10-week-old daughter with her boyfriend’s brother and elderly grandfather was upheld during the hearing and the case was referred to a Laurel grand jury. The September session of the grand jury will be held this week, with indictments returned in Laurel Circuit Court on Friday morning.
Kilburn and her boyfriend, Johnathan Haynes, reportedly left Kilburn’s infant daughter and 2-year-old son with Haynes’ relatives on Aug. 25. The couple told Haynes’ grandfather that Kilburn’s 7-year-old son had been in an accident and the couple needed to go to Tennessee where he was hospitalized and in critical condition. Haynes gave his grandfather a handwritten note asking for $1,500 to help pay for the child’s medical expenses. On Monday, Aug. 27, Haynes allegedly came back to the grandfather’s residence on Somerset Road, asking for more money.
Haynes’ grandfather said he gave his grandson more money to help with medical expenses and Haynes left. Later that night, Haynes’ brother went to check on the 10-week-old infant and discovered she was not breathing. Although the grandfather and the brother both attempted to revive the child until emergency workers arrived at the residence, the child was pronounced dead.
Haynes and Kilburn were both arrested later that night and are believed to have been in the London area from Saturday until their arrest. Kilburn’s older child had not been involved in an accident and was not in a Tennessee hospital or any other hospital. Authorities believed the couple had used the money lent to them to party in the area, thus initiating the abandonment charge against Kilburn.
