London heart doctor pleads 5th Amendment

LAUREL COUNTY, Ky. — A cardiologist named in numerous lawsuits claiming ‘unnecessary’ heart procedures were done at the London hospital has taken the Fifth Amendment in two cases.

As the motions and documentation from the earliest cases filed against the heart doctors get their day in court, Dr. Sandesh Patil responded to two cases by refusing to answer a key question.

In the case of Ricky Barker  and the case of Juanita Madden versus the heart doctors, Saint Joseph London, Catholic Health Initiatives, and other related businesses involved with the cardiologists and heart procedures performed, Patil used the Fifth Amendment of the U.S. Constitution and Article 11 of the Kentucky Constitution for his answer.

The question submitted to Patil in Ricky Barker’s case was: Admit you informed Ricky Barker that he required coronary artery bypass grafting.

Patil’s response was: “Objection. The Defendant objects to this request, hereby invoking his privilege against self-incrimination....”

In Juanita Madden’s lawsuit, Patil again took the 5th Amendment when asked: “Admit you informed Juanita Madden that she required transluminal coronary angioplasty (PTCA) with stenting.”

Scarlette Burton, an attorney with Poppe Law Firm in Louisville, said Patil has answered similar questions in other cases now scheduled for hearings in Laurel Circuit Court. However, she said those responses were vague.

Barker and Madden’s cases were both filed on May 24, 2012.
